Nike Faces Federal Probe Over Alleged Bias Against White Employees

Nike is facing a federal investigation after the US Equal Employment Opportunity Commission moved to compel the company to provide internal records related to alleged discrimination against white employees.

Nike’s shares have also reflected investor caution amid the federal probe. On February 5, 2026, Nike’s stock was trading near $63 down more than 50% from five-year highs as concerns over legal risk and broader market volatility weighed on sentiment. The stock’s recent decline adds pressure to the company’s long-term turnaround strategy, which is also navigating slowing global demand and competitive headwinds in the apparel market.
 

The EEOC filed an action in federal court in Missouri seeking enforcement of a subpoena issued to the sportswear giant. The agency said it is examining whether Nike’s diversity, equity, and inclusion programs unlawfully favored nonwhite employees in violation of federal civil rights law.

Andrea Lucas, chair of the EEOC, said the investigation is grounded in Title VII of the Civil Rights Act, which prohibits race-based discrimination in employment regardless of the employee’s race.

The agency stated that enforcement of anti-discrimination laws must be applied evenly and that protections extend to all workers. The probe appears to be among the first high-profile cases under the Trump administration’s renewed focus on alleged bias against white employees in corporate hiring, training, and mentorship programs.

Nike responded by pushing back against the action, calling it an unusual escalation after months of cooperation with regulators. A company spokesperson said Nike has already provided thousands of pages of documents and detailed responses as part of what it described as a good-faith engagement with the EEOC.

The company argued in court filings that several of the agency’s document requests are overly broad and seek information from periods well beyond the scope of the inquiry. Nike said it remains in the process of supplying additional material and plans to formally respond to the court action.

Unlike many EEOC cases, the investigation was not initiated by employee complaints. Court filings indicate it originated from a commissioner-led charge based on publicly available information, including Nike’s own corporate reports and website disclosures.

The case unfolds as the Trump administration intensifies scrutiny of corporate DEI policies. Since returning to office, President Donald Trump has issued executive actions aimed at curbing diversity programs across both government and private-sector institutions.

Employment law experts have noted that the EEOC has dropped or narrowed several pending discrimination cases involving minority and transgender workers while expanding investigations tied to alleged reverse discrimination.

Nike continues to deal with reputational challenges tied to workplace culture, following earlier lawsuits and internal reviews related to harassment and executive conduct. The outcome of the federal probe could have broader implications for how large US companies structure and defend diversity initiatives moving forward.
